A MEETING WITH NICK PAGET-BROWN

The Leader of the Council, Councillor Nick Paget-Brown was kind and gracious enough to come to Lancaster West  in September and meet with representatives of the Genfell Action Group, the Grenfell Tower Leaseholders Association and the Lancaster West Residents Association.  He wrote to us on 3rd October briefly setting out his recollection and understanding of the issues raised. This was indeed welcome and appears to have been  a clear indication of Councillor Paget-Brown’s  genuine and ongoing  interest in the problems besetting this community.  Paget-Brown letter

Unfortunately, some of the points in his letter were, in our view, somewhat  inaccurate, and seemed to betray a failure on his part to fully understand the issues we had brought to his attention, or at least to fully grasp our perspective and our particular concerns

In his letter he queried, for example, whether and why there is a perception among social tenants  that the Council might be trying to get rid of them, when it was already explained clearly to him, during the meeting,  that an important source  of such perceptions is the decision already made by the Council to withold from the new Regeneration Decant Policy the ‘guarantee’, previously included in the Core Strategy, that tenants decanted during regeneration would subsequently be allowed to return to their original neighbourhoods.  Needless to say this is a matter of great concern to social tenant groups boroughwide.

He asked if there might be a way for Lancaster West residents to control their domestic heating. This was, of course, the wrong question to ask. It is no secret in this community that the real issue is the urgent need to replace  the obsolete, dysfunctional and grossly energy inefficient district heating system – not just in Grenfell Tower but throughout the entire estate. The question for councillor Paget-Brown to address, therefore, is whether  the will exists in Council and TMO circles to locate and commit the substantial funding needed for these works.

He asked what caused the the Grenfell Tower power surges and why residents have not claimed against their own insurance. Once again we must express concern that he has not properly understood that most residents have no such insurance, because they cannot afford to pay for it.  More importantly, we believe very strongly that the TMO was negligent in this matter, which they deny, and it is therefore their responsibility to compensate residents for the loss of electrical appliances as a result of that negligence. The Council and the TMO (and their insurers)  have already refused such compensation based on the TMO’s contrived, and in our view disingenuous, denial of negligence.

We are therefore appealing directly to the Leader to fully understand the power surge victims’ predicament and to investigate if compensation can be paid from the £250,0000 that we have been told the Council keeps in reserve to meet such emergencies.  Grenfell Tower power surge victims would greatly appreciate the Leader’s direct involvement in helping us to resolve this painful issue which has further damaged the already fraught relationship between local residents  and the TMO – and by extension with the Council itself.

We are also very concerned that the health and safety aspect of the power surge crisis, and the very real fire risk faced by residents, has been covered up by the TMO, and we will be continuing to raise this issue with Cllr Marshall at the Scrutiny Committee.

Finally,  Councillor Paget-Brown pondered  whether the EMB ‘is any good’, and whether sufficient numbers of residents will volunteer to serve on it to make it work. The short answer to this question is, of course, that currently the EMB is indeed useless, but the real issue, which NPB needs to understand and address, is the constant disempowerment, undermining and marginalisation of the EMB, over many years, by both RBKC and TMO that is the root cause of its decline. The question therefore is – will Councillor Paget-Brown use his powers as Leader to reverse this undeclared policy of repression, and instead ensure that in future the EMB, and the Lancaster West Management Association which elects it, can count on the full and genuine support of the Council and the TMO, without which it can never function effectively?

It would be impossible for us to judge at this point whether Councillor Paget-Brown’s words are evidence that he missed the point on several important issues.  We seriously doubt this, and suspect that it is far more likely that his responses were carefully crafted to avoid making promises that might prove to be politically unpalatable, or beyond his power to deliver.  As already stated, he gave the impression that he was listening and that he was genuinely concerned about the issues at Lancaster West. We can only hope that he will therefore fully investigate these matters to ensure that he fully understands the issues. We should wait, therefore, to see what he will do.

He certainly knows how to talk the talk.

Let’s just wait and see now whether he can walk the walk also.

WHATEVER HAPPENED TO THE GRENFELL TOWER PROJECT – REPRISED

chaos-rulesWe thought our readers might be interested in the questions we posed in the below email to the TMO that raises concerns regarding the interminable delays to the Grenfell Tower improvement project. This latest correspondence followed a surprising statement we received from Mr Edward George at the RBKC Planning Dept.

We had contacted Mr George to find out when the Planning Committee might at last be expected to meet to decide the Grenfell Tower application, only to be stunned to learn that the current delays have “nothing to do with Planning” but are due to the apparent inability of the TMO to submit a Planning Application which is fit for purpose.

At the last resident engagement evening held at the EMB Rooms on September 19th Mr Maddison (Head of TMO Assests) claimed that the Grenfell Tower planning application was  on track and back in the hands of the Planning Dept for decision. The minutes from the same meeting, crudely stuck to the interior of the Grenfell Tower lifts, stated that “KCTMO are chasing the planning authority for updates regularly”.

The truth  however appears to be somewhat at odds with Mr Maddison’s version of events, and it seems that the TMO have still not managed to supply a planning application with the necessary Legal Agreement (See below). More delays to the timetable of the project would therefore appear to be inevitable. We have to question if the TMO are capable of delivering a project of this magnitude, and fear what they might have in store for residents if the works ever commence.

It appears from recent correspondence with Mr George (Senior Planning Officer) at RBKC that the Council’s Planning Dept is not responsible for the interminable delays to the Grenfell Tower improvement works and that the current hold up to the proposed works is the sole responsibility of the applicant, the TMO.

With this in mind, please can the TMO inform our community why your organisation did not submit a “draft legal agreement” when the Grenfell Tower planning application was first submitted in Sept 2012?

Please can the TMO inform our community how long the drafting of a satisfactory Legal Agreement will now be expected to take and when the TMO can expect the Grenfell Tower improvement project to finally come up before the Planning Applications Committee?

Are there any other issues likely to come to light that may further delay the TMO’s ability to submit a “fit for purpose” planning application?

Please could the TMO also answer the two additional questions posed below:
“We are now aware that the TMO have spent half a million pounds on the Grenfell Tower improvement project without establishing the basics of how the heating system will operate or submitting a planning application ready for approval? Who is monitoring this spending and how much money will be left to carry out the actual works?”

As soon as we get answers to these questions we will upload them to the blog ….But don’t hold your breath! Senior managers at the TMO seem to have an inability to respond to legitimate questions in a timely manner, and their response, when it eventually comes, will largely depend on whether they prove to be as dishonest as they are unprofessional.

The picture illustrating today’s blog was supplied by one of our most active members, who is, in our view, one of the unsung heroes of the Lancaster West community and who has, as a consequence, been frequently and unfairly criticised and savagely character-assassinated by some denizens of Hornton Street, regardless of political colour. The picture shows the unfinished Sports Hall of the new Academy and is remarkable in that it shows a complete absence of construction workers, or of construction activity, on this part of the site.  Our informant tells us there has been no such activity in this area during the last few weeks.

The reason for this was revealed at the most recent KALC Residents Forum held at the Methodist Church on Thursday 17th October.  Leadbitters have, it seems, been forced by design problems to suspend construction in this area, where the Academy’s sports hall is to be located. Leadbitters representatives became extremely prickly when pressed on the nature of the problem, and would only state that it was a temporary design problem which was “their problem to fix”.

They did not disclose how long this set-back might delay the construction of the Academy, but with the project being hurried through at such a pace, and all criticism dismissed out of hand from the planning stage onwards, there was always the possibility that some of  the crucial design features might prove to be misconceived and/or unexpectedly problematic.

With the first cohort of pupils expected on site in September 2014 let’s hope that Leadbitters can overcome their present problems and finish the Academy on time. We have been told all along that this is a deadline they cannot afford to miss!

We thought Grenfell Tower residents might be interested in the email below, sent by one resident on 17th October to Robin Yu, who handles Freedom of Information requests on the Council’s behalf. No criticism of Mr Yu is intended or implied in this post. In our experience he does his job competently and conscientously. On this occasion he quite properly referred the request to the Council’s legal team, who appear to have treated it with little respect.

WHY ARE WE NOT THE LEAST BIT SURPRISED BY THIS?

Dear Mr Yu,
Please could you ask RBKC Legal Services when I can expect to be given the information that I first requested, nearly thirty working days ago, on the 10th September 2013?
I was previously informed that I would be contacted by Legal Services on either Monday 14th or Tuesday 15th October but I have yet to receive any response. 
As I stated previously I require the information that I have requested in order to commence legal proceedings against RBKC Council as a result of their attempts to deny residents insurance payments and to cover up the seriousness of the catastrophic power surges that occurred in Grenfell Tower for three weeks in May 2013.
Please can you advise me what steps I can take to raise a formal objection to the length of time it is taking RBKC Legal Services to provide me with with this information?

A COMPLETE WASTE OF SPACE

During the brutal RBKC Council land grab, in October 2012, of the residential amenity space adjacent  to Grenfell Tower, our beloved green space (ie Lancaster Green) disappeared behind a 10ft high Berlin Wall.  Since then our once cherished parkland has remained out of bounds to local residents.

Since then the local community has looked on confused and aghast by the fact that this much needed green space has remained hidden behind hoardings, denied to the community as amenity space, while it remains untouched by the KALC construction work.  Clearly the landscaping of the open space around the new academy and leisure centre cannot proceed untl the new building complex is nearing completion. We are entitled to wonder, therefore, why these parts of Lancaster Green were fenced off and their use denied to the community when there was never any intention to expedite any works in this area, probably until some time next year.

Some time ago members of the Grenfell Action Group approached the Council’s contractor, Leadbitter, with the perfectly cogent suggestion that the green space in question might be returned for the community’s use until it is eventually needed for landscaping as part of the KALC project.  At present, there is no green space or playsplace anywhere within the vicinity of Grenfell Tower.

Please see below the complete lack of response that we got from Leadbitters’ employees, Mr Lynch and Ms Jeffs, to our perfectly reasonable and legitimate request.

One would imagine that a construction company as large as Leadbitter, and a member of the Considerate Constructors Scheme, would have some sort of service standard that it’s administrative staff are meant to adhere to in relation to responding to emails in a timely fashion and treating residents concerns with proper courtesy.

It appears that Ms Jeffs and her colleagues have no interest in either these protocols or in treating local residents with any semblance of respect or dignity.

And they wonder why Leadbitters are so despised and resented by the vast majority of the Lancaster West community.

It is difficult for residents to currently understand why we are being denied access to these areas as they sit totally dormant.

IT’S A DIRTY JOB….

Our regular readers won’t be surprised that, having failed earlier to elicit anything resembling an adequate response on the Grenfell Tower power surge issue from the Chair of the Council’s Scrutiny Committee, Councillor Quentin Marshall, we sent him another email on Friday 20th September in hope that we might get a more positive response this time through sheer persistence:

Dear Councillor Marshall,

I am writing to you on behalf of the Grenfell Action Group and the Grenfell Tower Leaseholders Association to request an urgent meeting with you in your capacity as Chair of the RBKC Housing and Property Scrutiny Committee.

We are obviously concerned about the power surge issue and the fact that, in the 16th July Scrutiny Committee report into the matter, it was stated that there was still confusion as to what precisely caused this issue.

If you recall, the surges caused significant damage to electrical equipment belonging to many of the residents of Grenfell Tower and caused much upset, alarm, and distress. Thankfully the damage was limited to property, but there are real worries amongst the residents that something more serious could have occurred or indeed could occur in the future.

In the run up to the July meeting of the Scrutiny Committee, the Grenfell Action Group wrote to you in your capacity as Chair (email dated 9th July 2013) and highlighted our concerns that the TMO were going to minimise the fire safety risk experienced by residents on 29th May. It looks like events have proved us right.

We subsequently invited you to attend a meeting with residents of Grenfell Tower where the power surge was discussed but you chose not to attend. We again emailed you on the 19th August and reiterated our concerns that the Scrutiny Committee needed to be have been vigilant of the TMO “cover up” and warned you that our community will not let this matter lie.

We have now had an opportunity to study the Scrutiny Committee minutes and the report that was submitted to the Scrutiny Committee from the TMO; we were extremely surprised with their content as it would appear that the seriousness of the matter is being downplayed, to say the least. It would seem very remiss for the Scrutiny Committee to simply accept the word of the TMO and ignore the explicit concerns regarding our health and safety we previously highlighted to your Members by email on the 9th July.

The only reference we can find to any fire risk or smoke being present at Grenfell Tower has appeared in our local Councillor Judith Blakeman’s own minutes and seemed to suggest that the TMO wished to explain away residents concerns’ of burning electrical appliances by telling the Scrutiny Committee that the smoke reported by residents had been caused by water falling on a hot surface and causing steam to rise! This is deeply insulting and shows a shockingly blasé attitude from the TMO.

We are also aware that Mr Black made allegations that the Grenfell Action Group and other local stakeholders had made misleading statements on our blog and in round robin emails. When we challenged Mr Black to substantiate these allegations (by informing us what statements he believed we gave that contained misleading information) he could not explain himself. Despite several opportunities Mr Black has failed to provide any evidence for the statements that he made to the Scrutiny Committee; we would therefore like this matter to be raised by you with Mr Black to ensure that the information he has provided the Scrutiny Committee is as full and frank as possible and does not contain such sweeping accusations which cannot be substantiated in future.

By now, you will no doubt be aware that the council’s insurer and claims handler, Zurich Municipal, have denied liability for this matter on behalf of the council and the TMO; an offer of £200 per household has been made but this will not cover the costs many households will have to replace their damaged property and fixtures. Many residents now face great hardship in these difficult financial times to replace the electrical appliances the TMO simply failed to protect.

We would therefore request that a meeting be convened between yourself and the affected residents of Grenfell Tower at the earliest mutual convenience; this would allow everyone to put their concerns forward and seek assurances from you that the matter will be brought to a conclusion satisfactory to all parties.
